It's always best to first speak with your neighbor. Perhaps the tree isn't as healthy as it looks! Did they get an evaluation from a certified arborist? Failing that, check with your municipality to see whether there is a tree ordinance that regulates the planting and removal of trees. Contact the municipality to see what permitting is required for trees in that location (are they on the street or in the back yard).
